This data privacy policy (hereinafter referred to as the Privacy Policy) applies to all personal data that you provide to us or that we collect and process when you use the services provided by Giedre Andre Photography (hereinafter referred to as the Photographer).

The Photographer respects your privacy and protects the personal data you provide to us and that we collect, as specified in this Privacy Policy. This Privacy Policy explains why we collect your personal data and how we use it.

Principles of personal data processing

The Photographer processes personal data in accordance with the European Union General Data Protection Regulation (EU) 2016/679 (hereinafter referred to as the Regulation), the Law on Legal Protection of Personal Data of the Republic of Lithuania, and other legal acts regulating the processing and storage of personal data.

The scope of personal data processed depends on the services provided by the Photographer and the information provided by the data subject when using the photographer's services, visiting the website, and/or registering for photo shoots.

Data is processed only if one or more of the criteria for lawful processing are met. In order to ensure the provision of the requested information, the provision of services upon request and with the consent of the data subject.

Access to personal data processed by the Photographer is granted to the Photographer and auxiliary service providers who need it to perform their work functions or provide services (makeup artists, couriers, etc.).

When you register for a photo shoot, the data you provide is used only to fulfill your order. Without your permission, this data will not be used for any other purpose, nor will it be transferred or sold to third parties not related to the provision of our direct services.

Sourses of personal data

Personal data is obtained directly from the data subject (service customer) who provides it when using the services provided by the Photographer or when visiting the website and/or social networks.

Concequences of not providing data

Although a person is not required to provide any personal data to the Photographer, certain services may not be provided to them if personal data is not provided.

Processing of personal data for the purpose of providing photography

The client's personal data (specifically, first name, last name, date of birth, address, telephone number, email address) is stored for 5 years from the date of submission. After this period, the personal data is destroyed.

Photos and videos taken during the photo shoot, as well as parts thereof, may be published on the Photographer's Facebook account, Instagram account, website, as well as on other social networks, advertising or information dissemination media.

Photos and videos from the photo shoot are taken on the basis of a condition aimed at fulfilling the service agreement to which the data subject is a party, as well as our legitimate interest in using this material, including but not limited to presentation, advertising, social media networks, and artistic purposes. Pursuant to Article 4 of the ADTAĮ, exceptions are established for cases where personal data is processed in order to exercise freedom of expression and information:

When personal data is processed for journalistic or academic, artistic, or literary self-expression purposes, Articles 8, 12–23, 25, 30, 33–39, 41–50, and 88–91 of Regulation (EU) 2016/679 do not apply.

For this purpose, we may process your photos taken during the provision of the service. This data will be processed on the basis of your consent (when choosing a discounted photo shoot and agreeing to publish the photos). If you purchase a discounted service (where you agree to the publication of the photo shoot results for the purposes mentioned above) and then withdraw your consent, the photographer must be paid the full price of the service.

Photos and videos will be stored for 1 year from the moment they are taken.

Cookies

Cookies are used to ensure high-quality and fast browsing on the Photographer's website. Cookies are text files containing small amounts of information that are sent to your browser and stored on your computer, mobile phone, or other device when you visit a website. Each time you visit the same website, cookies send information back to that website. Cookies are used to collect your data on the basis of your consent, except for strictly necessary cookies.

If a website visitor does not agree to cookies being stored on their computer or other terminal device, they can change their web browser settings and disable all cookies or enable/disable them individually.

Data storage period

We process and store all your personal data collected by the means specified above for no longer than is necessary for the purposes specified in this Privacy Policy.

The photographer applies the security and management requirements for data processing set out in the Law on Legal Protection of Personal Data of the Republic of Lithuania and the General Data Protection Regulation of the European Union.

The Photographer takes appropriate technical and organizational measures to ensure the protection of all personal data processed against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access, and against all other forms of unlawful processing.

Data subjects' rights

You have the following rights in relation to your personal data:

to request that the Photographer allow you to access, correct, or delete your data, or restrict the processing of your data;

the right to object to the processing of your data;

the right to receive your personal data in a structured, digital format (right to data portability);

the right to withdraw consent;

the right to lodge a complaint with the State Data Protection Inspectorate.
